1. Acceptance of These Terms
These Terms of Use (“Terms”) govern your use of ciancimedia.com (the “Site”), operated by Cianci Media (“Cianci Media,” “we,” “us,” or “our”). By using the Site, you agree to these Terms and to our Privacy Policy, available at ciancimedia.com/privacy-policy. If you do not agree, please do not use the Site.
2. Information Only; Client Services
The Site gives general information about our social media, community management, content, and AI-assisted marketing services. Nothing on the Site is an offer or a binding agreement. All client work is governed by a separate written agreement (such as a proposal, statement of work, or service agreement). If that agreement conflicts with these Terms, the client agreement controls.
3. Intellectual Property
The Site and its content, including text, graphics, logos, images, videos, and design, are owned by Cianci Media or our licensors and are protected by copyright, trademark, and other laws. You may view and print pages for your personal, non-commercial use. You may not copy, modify, distribute, sell, or create derivative works from our content without our written permission. Client logos and work samples are shown with permission and belong to their owners.
4. User Conduct
When you use the Site, you agree not to:
- break any law or violate anyone’s rights;
- send spam, false information, or harmful content through our forms;
- try to gain unauthorized access to the Site or its systems, or disrupt its operation;
- use bots, scrapers, or other automated tools to access or copy the Site;
- impersonate any person or business.
5. No Guaranteed Results
Social media and marketing results depend on many factors outside our control, including platform algorithms, market conditions, and each business’s products and actions. We do not guarantee any specific results, such as follower growth, engagement, leads, or sales.
5A. Subscription Plans (Hours Bank)
- Automatic monthly billing. Subscriptions renew and are charged automatically each month on your billing date until you cancel.
- Hours bank. Each plan includes a monthly number of service hours: Fundador 3 hours ($150/month), Esencial 3 hours ($190/month), Crecimiento 8 hours ($490/month), Socio 16 hours ($950/month). You choose how to spend them using our published hours table.
- Rollover. Unused hours roll over for a maximum of 2 months while your subscription is active. Hours not used within that period expire. All unused hours are lost when the subscription is canceled and have no cash value.
- Additional hours cost $70 per hour.
- Fundador plan. Available only to our first 10 clients and only during their first 3 months. After that, the subscription moves to the Esencial plan or another plan you choose.
- Website creation. Domain costs (and any third-party fees we are charged for your website) are billed separately in addition to the plan hours.
- Cancellation. You can cancel at any time before your next billing date; cancellation takes effect at the end of the current billing period.
- No refunds for hours already used or for billing periods already charged, except where required by law.
5B. Service-Specific Disclaimers
- Paid ads. Ads management is an optional extra. The advertising budget is paid by you directly to Meta, Google or the relevant platform and is not part of the plan price; platform charges and ad approval are controlled by those platforms.
- Google Business. We do not control Google and cannot guarantee verification, approval, ranking or visibility of any Google Business profile.
- Drone services. Drone flights are subject to FAA rules, airspace restrictions, any required authorization, location permissions and weather. We may postpone or decline a flight when it cannot be done safely or legally.
- Results. As stated in Section 5, we do not guarantee specific results such as followers, reach, leads or sales.
5A. Planes de suscripción (banco de horas)
- Cobro mensual automático. La suscripción se renueva y se cobra automáticamente cada mes en tu fecha de facturación hasta que la canceles.
- Banco de horas. Cada plan incluye un número mensual de horas de servicio: Fundador 3 horas ($150/mes), Esencial 3 horas ($190/mes), Crecimiento 8 horas ($490/mes), Socio 16 horas ($950/mes). Tú eliges en qué usarlas según nuestra tabla de horas publicada.
- Acumulación. Las horas no usadas se acumulan por un máximo de 2 meses mientras la suscripción esté activa. Las horas no usadas en ese plazo vencen. Todas las horas no usadas se pierden al cancelar la suscripción y no tienen valor en efectivo.
- Horas adicionales: $70 por hora.
- Plan Fundador. Disponible solo para nuestros primeros 10 clientes y solo durante sus primeros 3 meses. Después, la suscripción pasa al plan Esencial o al plan que elijas.
- Creación de página web. El costo del dominio (y cualquier cargo de terceros que nos cobren por tu sitio) se factura aparte, además de las horas del plan.
- Cancelación. Puedes cancelar en cualquier momento antes de tu próxima fecha de cobro; la cancelación se aplica al final del periodo en curso.
- No hay reembolsos por horas ya usadas ni por periodos ya cobrados, salvo cuando la ley lo exija.
5B. Avisos sobre servicios específicos
- Anuncios pagados. El manejo de anuncios es un extra opcional. El presupuesto publicitario lo pagas directamente a Meta, Google o la plataforma correspondiente y no forma parte del precio del plan; los cargos y la aprobación de anuncios dependen de esas plataformas.
- Google Business. No controlamos Google y no garantizamos la verificación, aprobación, posicionamiento ni visibilidad de ningún perfil de Google Business.
- Servicios con dron. Los vuelos están sujetos a las normas de la FAA, restricciones del espacio aéreo, autorizaciones necesarias, permisos del lugar y el clima. Podemos posponer o rechazar un vuelo si no puede hacerse de forma segura o legal.
- Resultados. Como indica la Sección 5, no garantizamos resultados específicos como seguidores, alcance, clientes potenciales o ventas.
5A. Piani in abbonamento (monte ore)
- Addebito mensile automatico. L'abbonamento si rinnova e viene addebitato automaticamente ogni mese alla data di fatturazione finché non lo annulli.
- Monte ore. Ogni piano include un numero mensile di ore di servizio: Fundador 3 ore ($150/mese), Esencial 3 ore ($190/mese), Crecimiento 8 ore ($490/mese), Socio 16 ore ($950/mese). Scegli tu come usarle secondo la nostra tabella ore pubblicata.
- Accumulo. Le ore non usate si accumulano per un massimo di 2 mesi finché l'abbonamento è attivo; oltre quel periodo scadono. Tutte le ore non usate si perdono con l'annullamento dell'abbonamento e non hanno valore in denaro.
- Ore aggiuntive: $70 l'ora.
- Piano Fundador. Disponibile solo per i nostri primi 10 clienti e solo per i loro primi 3 mesi. Dopo, l'abbonamento passa al piano Esencial o a un altro piano a tua scelta.
- Creazione sito web. Il costo del dominio (ed eventuali costi di terzi per il tuo sito) è fatturato a parte, oltre alle ore del piano.
- Annullamento. Puoi annullare in qualsiasi momento prima della prossima data di addebito; l'annullamento ha effetto alla fine del periodo in corso.
- Nessun rimborso per ore già utilizzate o periodi già addebitati, salvo quanto previsto dalla legge.
5B. Avvertenze su servizi specifici
- Inserzioni a pagamento. La gestione delle inserzioni è un extra opzionale. Il budget pubblicitario lo paghi direttamente a Meta, Google o alla piattaforma interessata e non fa parte del prezzo del piano; addebiti e approvazione delle inserzioni dipendono da tali piattaforme.
- Google Business. Non controlliamo Google e non garantiamo verifica, approvazione, posizionamento o visibilità di alcun profilo Google Business.
- Servizi con drone. I voli sono soggetti alle norme FAA, alle restrizioni dello spazio aereo, alle autorizzazioni necessarie, ai permessi del luogo e al meteo. Possiamo rinviare o rifiutare un volo se non è possibile svolgerlo in modo sicuro o legale.
- Risultati. Come indicato nella Sezione 5, non garantiamo risultati specifici come follower, copertura, contatti o vendite.
6. Testimonials and Case Studies
Any testimonials or case studies shown on the Site will come from real clients and are shared with their permission. They reflect the experience of those clients. Results are not typical, and your results may vary. We do not pay for positive reviews. If a reviewer has a material connection to us, we disclose it.
7. Third-Party Links and Platforms
The Site may link to third-party websites and platforms, such as Instagram, Facebook, TikTok, and Google. We do not control those sites and are not responsible for their content, policies, or practices. Your use of them is governed by their own terms and privacy policies.
8. Disclaimer of Warranties
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CIANCI MEDIA AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).
10. Indemnification
You agree to defend, indemnify, and hold harmless Cianci Media and its owners, employees, and contractors from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or your violation of these Terms.
11. Governing Law and Venue
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Salt Lake County, Utah, and you consent to the jurisdiction of those courts.
12. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page and change the effective date above. Your continued use of the Site after changes are posted means you accept the updated Terms.
